Section 2 – General Duties of Employers to Their Employees​

Section 2(1)

“It shall be the duty of every employer to ensure, so far as is reasonably practicable, the health, safety and welfare at work of all his employees.”

​

Section 2(2)(e)

“The matters to which that duty extends include…
(e) the provision and maintenance of a working environment for his employees that is, so far as is reasonably practicable, adequate as regards facilities and arrangements for their welfare at work.”

CDM 2015 — Schedule 2 Minimum Welfare (Construction Phase)

Schedule 2 (abridged) requires that construction sites provide:

​

1.—(1) Suitable and sufficient sanitary conveniences must be provided or made available at readily accessible places.

 

2.—(1) Suitable and sufficient washing facilities, including showers if required by the nature of the work or for health reasons, must, so far as is reasonably practicable, be provided or made available at readily accessible places.

 

3.—(1) An adequate supply of wholesome drinking water must be provided or made available at readily accessible and suitable places.

 

4.—(1) Suitable and sufficient changing rooms must be provided or made available at readily accessible places 

 

5.—(1) Suitable and sufficient rest rooms or rest areas must be provided or made available at readily accessible places.

Regulation 20 – Sanitary Conveniences

“Suitable and sufficient sanitary conveniences shall be provided at readily accessible places. They shall be adequately ventilated and lit, kept clean, and separate for men and women unless each convenience is in a separate room with a lockable door.”

Regulation 21 – Washing Facilities

“Suitable and sufficient washing facilities, including hot and cold, or warm water, soap or other suitable means of cleaning, and towels or other suitable means of drying, shall be provided at readily accessible places.”

Regulation 25 – Facilities for Rest and to Eat Meals

“Suitable and sufficient rest facilities shall be provided, including facilities to eat meals where necessary.”
